DRIVELUX LLC • Florida Rental Agreement
Terms & Conditions
Read Before Signing
This Agreement is intended for short-term motor vehicle rentals. The final agreement, rate sheet, insurance/protection documents, and operational policies must be consistent with DRIVELUX LLC's actual business practices and applicable law.
“Company” means DRIVELUX LLC. “Renter” means the person signing this Agreement. “Authorized Driver” means the Renter or another driver expressly approved by the Company. “Vehicle” means the motor vehicle identified in the Rental Agreement.
The complete transaction may include this Agreement, the checkout/rental record, vehicle condition report, rate and fee disclosure, optional protection-product documents, and any written amendments. If a conflict exists, mandatory law controls and the documents should be interpreted consistently to the extent possible.
The Company will not rent a vehicle to a person unless that person is duly licensed to drive. Before releasing the vehicle, the Company will inspect the driver's license and verify that it is unexpired, as required by Fla. Stat. §322.38. A nonresident must be licensed under the laws of the person's state or country of residence, subject to Florida law.
For digital/self-service rentals, the Company may use the verification procedure authorized by §322.38(4), including requiring the renter to verify that the license is valid and unexpired at enrollment or thereafter.
The Company will maintain the rental records required by Fla. Stat. §322.38, including the vehicle registration number, renter name and address, driver's-license number, and place of issuance. The Renter authorizes reasonable identity, license, payment, fraud-prevention, and eligibility checks.
False, altered, expired, suspended, revoked, or mismatched identification may result in refusal or cancellation of the rental, subject to applicable law.
The Company's minimum age, young-driver policy, additional-driver requirements, and any age-based fees must be stated in the current rate sheet or Rental Agreement. The Company may apply lawful eligibility criteria uniformly and may require additional documentation or payment authorization.
A reservation is subject to vehicle availability and completion of the Company's eligibility and payment requirements. Vehicle class substitutions, upgrades, or other changes should be documented in the rental record. Reservation cancellation and no-show charges, if any, must be disclosed before acceptance and must comply with applicable law.
The rental begins at the date and time shown in the Rental Agreement and continues until the Vehicle is returned to the agreed location and accepted by the Company, unless an extension is authorized.
An extension must be requested before the scheduled return time. The Company may charge the applicable rate for the extended period and any disclosed fees. An unauthorized holdover is a material breach and may result in additional lawful charges and vehicle-recovery action.
The Renter agrees to pay the base rental rate, applicable taxes, disclosed mandatory charges, optional products selected by the Renter, and charges arising from the Renter's use or breach as permitted by law.
All material rates and fees should be disclosed in the booking flow, rate sheet, or Rental Agreement. The Company may process the payment method for amounts authorized under this Agreement and applicable law.
If a security deposit or incidental authorization is required, its amount and release policy should be stated in the Rental Agreement or rate disclosure. The Company may use the authorization for amounts properly due under the Agreement, including unpaid rental charges, disclosed fees, fuel, tolls, citations, cleaning, and covered damage claims, subject to applicable law.
The Renter remains responsible for lawful charges that exceed the initial authorization.
Before departure, the Renter should inspect the Vehicle and report visible damage or missing equipment. The Company should document pre-existing damage by photographs, checklist, or electronic condition report.
By accepting the Vehicle, the Renter acknowledges the condition recorded at pickup, except for discrepancies promptly reported to the Company.
Only the Renter and Authorized Drivers may operate the Vehicle. Each Authorized Driver must satisfy the Company's license and eligibility requirements. The Renter is responsible for ensuring that no unauthorized person drives the Vehicle.
The Company may deny a driver who does not satisfy lawful eligibility requirements or cannot provide required documentation.
The Vehicle may be used only for lawful transportation consistent with its design and the Rental Agreement. The Renter must comply with all traffic, parking, toll, registration, and other applicable laws.
The Renter must operate the Vehicle safely, use reasonable care, secure the Vehicle when unattended, and follow manufacturer safety instructions.
Unless the Company expressly authorizes the use in writing, the Vehicle may not be used for racing, speed testing, off-road driving, towing or pushing, transporting hazardous materials, sub-rental, vehicle-sharing to another renter, commercial passenger transportation, unlawful activity, or any use prohibited by the Vehicle's insurance policy.
The Vehicle may not be driven while the driver is impaired by alcohol, drugs, or another substance that makes driving unsafe.
Smoking/vaping, pets, and other interior-use restrictions may be enforced when disclosed in the Company's policy and rate materials.
The Vehicle may be operated only in permitted geographic areas stated by the Company. Travel outside the United States or into restricted areas requires prior written authorization and may be prohibited by the Company's insurance policy. The Renter must comply with all border-crossing requirements and return the Vehicle as agreed.
The Vehicle must be returned with the fuel or charge level specified at pickup unless the selected rental plan states otherwise. If the Company refuels or recharges the Vehicle, the applicable disclosed service rate and any permitted fee may be charged.
The rental's included mileage, if any, must be stated in the Rental Agreement or rate sheet. Excess mileage charges apply only when disclosed and accepted. The Company may document beginning and ending odometer readings.
The Renter must return the Vehicle by the agreed date and time. Late-return charges, rate changes, or other disclosed fees may apply. Early return does not automatically entitle the Renter to a refund unless the applicable rate or cancellation policy provides one.
The Renter is responsible for tolls, parking charges, traffic and parking citations, towing/impound charges, and other governmental or third-party charges arising from the Renter's use of the Vehicle, plus any disclosed administrative processing fee permitted by law.
The Company may provide identifying rental information to toll operators or governmental authorities when legally required or reasonably necessary to process such charges.
After an accident, the Renter must stop safely, contact emergency services when appropriate, comply with legal reporting requirements, exchange information as required by law, and promptly notify the Company.
The Renter must cooperate with the Company's insurer and claims process. The Renter should not admit fault, make a settlement, or promise payment on behalf of the Company without authorization.
The Renter must promptly notify law enforcement and the Company of theft, attempted theft, vandalism, loss of keys, or material damage. The Renter must provide the police report number and other requested information.
The Vehicle may not be abandoned, transferred, hidden, or surrendered to an unauthorized person or location.
Subject to applicable law, the Renter may be responsible for loss or damage occurring during the rental when caused by the Renter, an Authorized Driver, an unauthorized driver, or another circumstance for which the Renter is contractually responsible. Charges should be supported by reasonable documentation such as photographs, estimates, invoices, diminished-value documentation where legally recoverable, towing/storage records, or other appropriate evidence.
Nothing in this clause creates liability that applicable law or an applicable insurance policy prohibits the Company from imposing.
To the extent permitted by applicable law and the applicable agreement, the Company may seek reasonable, documented costs associated with a covered loss, including reasonable towing, storage, recovery, appraisal, administrative processing, and loss-of-use amounts when legally recoverable. Any charge must be consistent with the governing law, applicable insurance, and the disclosures made to the Renter.
Florida Statute §627.7263 provides that valid and collectible liability insurance or personal injury protection insurance covering the lessor of a motor vehicle for rent or lease is primary unless otherwise stated in at least 10-point type on the face of the rental or lease agreement.
If the agreement makes the authorized rental driver's insurance primary, Florida law requires the statutory language below to appear in at least 10-point type:
DRIVELUX confirms applicable policy terms and statutory provisions with its commercial rental-car insurer and legal counsel.
Collision/loss damage waiver, supplemental liability protection, personal accident protection, roadside assistance, and similar products are optional only when presented as optional and accepted by the Renter, unless a product is required by law or by a separate lawful contract term.
Each product is governed by its own terms, limits, conditions, and exclusions. The Renter should receive the applicable disclosure before purchase.
Nothing in this Agreement changes the limits, exclusions, conditions, priority, or definitions contained in an insurance policy. Insurance questions and claims are governed by the applicable policy and Florida law.
The Company should not promise coverage beyond the actual policy. Any statement concerning primary or secondary insurance should be reviewed against the Company's current policy and §627.7263.
The Renter must promptly report mechanical problems, warning lights, tire damage, overheating, or safety concerns. The Renter must stop operating the Vehicle when continued operation could reasonably create a safety hazard or materially worsen damage.
Roadside assistance is subject to the selected plan and its terms. Unauthorized repairs may not be reimbursed unless emergency circumstances or the Company's written authorization supports reimbursement.
The Renter is responsible for returning all keys, key fobs, chargers, accessories, documents, equipment, and other Company property. Loss or damage may result in a reasonable documented replacement or repair charge when permitted by law and disclosed.
The Vehicle must be returned in substantially the same reasonably clean condition, ordinary use excepted. Where disclosed, the Company may charge a reasonable cleaning or remediation fee for excessive dirt, spills, smoking/vaping residue, pet-related damage, biohazard contamination, or persistent odors requiring professional remediation.
The Company maintains a written fee schedule and documentation supporting such charges.
The Company is not responsible for personal property left in the Vehicle except to the extent required by applicable law. The Renter should remove all property before returning the Vehicle. Found property may be handled under the Company's lost-and-found policy.
If the Vehicle contains GPS, telematics, connected-car, immobilization, or security technology, the Company may collect and use information as permitted by applicable law for fleet management, maintenance, safety, theft recovery, fraud prevention, billing, and administration.
The Renter may not disable, remove, or interfere with such equipment. The Company provides separate privacy disclosures required by applicable law.
Where legally permitted, the Company may use electronic signatures, electronic photographs, digital condition reports, electronic receipts, and electronic communications to document the rental. The Renter is responsible for providing accurate contact information and maintaining access to the email or phone used for the transaction.
The Company may collect identification, license, payment, rental, vehicle, location/telematics, claims, and transaction information for lawful business purposes. Information may be disclosed to insurers, payment processors, law enforcement, toll authorities, service providers, or other parties when reasonably necessary, authorized, or legally required.
Please review the Company's separate Privacy Policy for a detailed description of applicable privacy rights and data practices.
The Company complies with Florida vehicle-registration and rental-company requirements. Florida Statute §320.0601 restricts certain exterior bumper stickers, insignias, or advertising identifying a vehicle as a rental vehicle, subject to statutory exceptions. The Company ensures fleet markings comply with current statutory standards.
The Company and Renter intend to comply with applicable Florida and federal requirements, including motor-vehicle, insurance, consumer-protection, payment, accessibility, privacy, and anti-discrimination laws. Nothing in this Agreement waives a nonwaivable legal right or creates a right prohibited by law.
Material breach may include nonpayment, unauthorized use, unauthorized driver operation, false information, failure to return the Vehicle, prohibited use, or conduct that creates a material risk to people or property.
The Company may terminate the rental and pursue lawful remedies to recover the Vehicle or amounts due. The Company will not use self-help measures that are prohibited by law.
To the extent permitted by applicable law and not covered by the Company's legal obligations or insurance, the Renter agrees to reimburse the Company for documented losses, charges, fines, penalties, damage, or expenses caused by the Renter's breach of this Agreement or prohibited/unauthorized use. This clause does not waive or limit rights that cannot legally be waived or limited.
Florida law is intended to govern this Agreement to the extent permitted by law. Any dispute must be brought in a court or other forum having lawful jurisdiction, subject to any mandatory consumer-protection, arbitration, venue, or other requirements applicable to the transaction.
If any provision is determined to be invalid or unenforceable, it will be enforced to the maximum extent permitted by law and the remaining provisions will continue in effect to the extent legally permitted.
A failure by either party to enforce a provision on one occasion does not necessarily waive the right to enforce it later. Any waiver should be documented in writing.
The signed Rental Agreement and incorporated documents represent the agreement concerning the rental, subject to mandatory law. Changes to material terms should be documented and accepted by the parties. No employee is authorized to waive a material term unless the Company has granted that authority.
The Renter should receive or have access to an exact copy of the executed rental documents. The Renter should not sign with material blank spaces or without reviewing the applicable rates, fees, insurance/protection selections, and vehicle condition report.
By executing a rental transaction with DRIVELUX LLC, the Renter certifies that all information provided is accurate; acknowledges review of the rental rate, fees, insurance/protection selections, vehicle condition, and these Terms & Conditions; understands all responsibilities regarding authorized drivers, lawful use, accidents, tolls, citations, fuel, mileage, return, and damage; and agrees to the Agreement subject to applicable law.
